These terms govern every sale concluded by Fluesco SRL on fluesco.com, with consumers as well as business customers. English translation of the French version; in case of discrepancy, the French text prevails.
Article 1 — Identification of the seller
The website fluesco.com is operated by Fluesco SRL, a company incorporated under Belgian law, with its registered office at Grand Pré 4a, 4690 Glons (Belgium).
- Company number (CBE): BE 0628502491
- VAT number: BE 0628.502.491
- E-mail: info@fluesco.com
- Telephone: +32 (0) 479 92 02 03
- Bank account: IBAN BE91 1030 3849 0476 — BIC NICABEBB
Fluesco SRL is referred to below as “Fluesco” or “the seller”. The “customer” is any natural or legal person who places an order on the website. The “consumer” is a customer who is a natural person acting for purposes outside their professional activity; the “business customer” is any other customer.
Article 2 — Scope and acceptance
These general terms apply to every order placed on fluesco.com and to every distance sale concluded by Fluesco. They prevail over any purchasing conditions of the customer, unless Fluesco has agreed otherwise in writing.
By confirming an order, the customer declares that they have read these terms and accept them without reservation. The terms can be consulted at any time on the website and are sent to the customer on a durable medium together with the order confirmation.
Fluesco may amend these terms at any time; the version applicable to an order is the one in force on the day the order is confirmed. Article 8 contains the provisions specific to business customers; Articles 6 and 7 apply only to consumers, unless stated otherwise.
Article 3 — Offer, prices and orders
Prices. Prices are stated in euros, inclusive of all taxes (Belgian VAT at 21 %) for consumers, and exclusive of VAT for business customers identified as such on their account. The statutory environmental contributions (Recupel, Bebat, Auvibel, Reprobel) are included in the displayed price and itemised separately on the invoice. Delivery costs are shown before the order is confirmed.
Availability and errors. The catalogue is fed automatically by Fluesco's suppliers; prices and stock levels are updated several times a day. Despite this care, an obvious error in price or description (a derisory price, an impossible specification) does not bind Fluesco: the customer is informed and may cancel the order free of charge. Products shown as “temporarily out of stock — contact us” cannot be ordered online; Fluesco provides a lead time on request.
Conclusion of the contract. The order follows these steps: basket, identification, choice of delivery and payment, summary, confirmation. The contract is concluded when the customer receives the order confirmation e-mail sent by Fluesco after the payment has been validated. Fluesco reserves the right to refuse or cancel an order in the event of a previous dispute with the customer, suspected fraud, abnormal quantities or permanent unavailability of the product; any sums paid are then refunded in full within 14 days.
Products to order. Products advertised with an availability date are sold on pre-order; the date is indicative and communicated by the supplier. A delay of more than 30 days beyond that date entitles the consumer to cancel the order and be refunded.
Article 4 — Payment
Payment is made at the time of the order, at the customer's choice:
- by credit or debit card, Bancontact, Apple Pay, Google Pay and Link, through the payment provider Stripe (secure payment; Fluesco stores no card data);
- by bank transfer to the account stated in Article 1, quoting the order number as reference. The order is processed on receipt of the transfer; if payment is not received within 7 days, the order is cancelled.
For card payments, Fluesco obtains an authorisation at the time of the order and captures the amount when the goods are dispatched. The invoice is sent separately by e-mail after dispatch. Fluesco remains the owner of the products until full payment (Article 9).
Article 5 — Delivery and collection
Area and methods. Fluesco delivers in Belgium, Luxembourg, the Netherlands and France. The customer chooses between free collection in Glons (by appointment, after the “order ready” e-mail) and delivery by carrier (bpost or another carrier); the costs are displayed before confirmation and are waived for purchases of 100 € including VAT or more delivered in Belgium.
Lead times. Products in stock are dispatched within 1 to 3 working days of the order confirmation; products to order are dispatched as soon as they are received from the supplier. Lead times are indicative; in any event, delivery to a consumer takes place no later than 30 days after the contract is concluded, unless agreed otherwise. After that period, and after a formal notice that remains without effect within a reasonable additional period, the consumer may terminate the contract and obtain a refund of the sums paid.
Receipt. The customer checks the condition of the parcel on delivery. Any visible damage or missing product must be reported to Fluesco by e-mail within 48 hours, with photos; after that period, and without prejudice to the legal warranty, the delivery is deemed compliant as regards transport damage. For consumers, the risk of loss or damage passes on physical handover of the product.
Article 6 — Right of withdrawal (consumers)
In accordance with Book VI of the Belgian Code of Economic Law, the consumer has 14 calendar days to withdraw from the contract without giving any reason. The period starts on the day the consumer, or a third party designated by them, takes physical possession of the product (of the last product in the case of a split delivery).
How to exercise this right. The consumer notifies their decision before the period expires, by e-mail to info@fluesco.com or by post to the address in Article 1, using the form in the annex or any other unambiguous statement. Fluesco acknowledges receipt by e-mail.
Returning the product. The product is returned or handed over to Fluesco without undue delay and no later than 14 days after the notification, complete, in its original packaging, with its accessories and documents. The direct cost of returning the product is borne by the consumer. The consumer is liable only for any diminished value resulting from handling beyond what is necessary to establish the nature, characteristics and functioning of the product; a device that has been configured, activated or registered with the manufacturer may give rise to diminished value.
Refund. Fluesco refunds all payments received, including standard delivery costs, no later than 14 days after being informed of the withdrawal, using the same means of payment. Fluesco may withhold the refund until it has received the product or proof that it has been sent.
Exceptions. The right of withdrawal does not apply:
- to software, licences and digital content unsealed or activated after delivery, nor to licence keys supplied electronically whose performance has begun with the consumer's consent;
- to products configured or personalised to the customer's specifications (for example configure-to-order systems);
- to sealed products which cannot be returned for hygiene reasons and which have been unsealed (in-ear headphones, for example).
Article 7 — Legal warranty and after-sales service
Legal warranty of conformity (consumers). The consumer benefits from a legal warranty of two years from delivery for any lack of conformity (Articles 1649bis et seq. of the former Belgian Civil Code). Any defect that appears within two years is presumed to have existed at the time of delivery, unless proven otherwise. For second-hand or refurbished products the warranty is one year, where stated on the product page. The consumer reports the defect to Fluesco within two months of discovering it.
In the event of a defect, the consumer is entitled to free repair or replacement of the product within a reasonable time; where this is impossible or disproportionate, to a price reduction or termination of the sale. Digital elements (software, updates) integrated in the products are covered under the conditions laid down by law.
Manufacturer's commercial warranty. Some manufacturers offer their own warranty (duration, on-site service, paid extension). It is in addition to the legal warranty and does not replace it; its conditions are those of the manufacturer.
Exclusions. The following are not covered: normal wear and tear, consumables (batteries beyond normal degradation, cartridges, toners), damage caused by abnormal use, impact, humidity, power surges, intervention by an unauthorised third party, software or configuration installed by the customer, and loss of data. The customer backs up their data before any return.
Procedure. Any warranty claim is submitted by e-mail to info@fluesco.com with the order number and a description of the defect. Fluesco indicates the procedure to follow (return to Fluesco or direct handling by the manufacturer). The cost of returning a product acknowledged as defective is refunded to the consumer.
Article 8 — Special conditions for business customers
The following provisions apply to business customers and, for them, prevail over the preceding articles.
- Prices and invoicing. Prices are stated exclusive of VAT. The invoice is issued after dispatch and sent separately by e-mail. The VAT number provided by the customer is verified; a VAT-exempt intra-Community supply requires a valid VAT number and proof of transport out of Belgium.
- Payment. Unless a customer credit line has been granted in writing, payment is due at the time of the order. Invoices on credit terms are payable 30 days from the invoice date. Any invoice unpaid at its due date bears interest automatically and without notice at the rate set by the Belgian Act of 2 August 2002 on combating late payment in commercial transactions, plus a fixed compensation of 40 € for recovery costs, without prejudice to further damages. Fluesco may suspend pending deliveries as long as an overdue invoice remains unpaid.
- No right of withdrawal. Article 6 does not apply. A return is possible only with Fluesco's prior written agreement, for a new, unopened product, within 14 days of delivery, subject to a restocking fee of up to 15 % of the price and the cost of return transport. Products to order, configured products and software are not taken back.
- Warranty. The business customer benefits from the manufacturer's commercial warranty and from the legal warranty against hidden defects; any visible defect is reported within 48 hours of delivery, any hidden defect within 8 days of its discovery. Fluesco's liability is limited, at Fluesco's choice, to repair, replacement or refund of the product.
- Quotations and projects. Quotations are valid for 15 days, subject to availability and to changes in supplier prices or exchange rates. Services (installation, configuration, support) are subject to separate terms.
Article 9 — Retention of title and transfer of risk
Fluesco retains ownership of the delivered products until full payment of the price, including principal, interest and costs. Until then the customer may not resell, transform or pledge them, and insures them against any damage. In the event of non-payment, Fluesco may take the products back at the customer's expense.
For consumers, risk passes on physical handover of the product (Article 5). For business customers, risk passes when the products are handed over to the carrier, or when they are made available in the case of collection.
Article 10 — Liability
Descriptions, photos and technical data sheets come from the manufacturers and from specialised databases; they are provided for information and have no contractual value beyond the essential characteristics of the product. Before ordering, the customer ensures that the product is compatible with their environment; Fluesco can advise on request.
Fluesco is not liable for indirect damage (loss of data, business interruption, loss of profit, damage to reputation), nor for the consequences of force majeure (supply interruption at the manufacturer, strike, network failure, decision of the authorities). Towards consumers, this limitation does not affect their statutory rights, in particular the warranty of conformity and liability for defective products. In any event, Fluesco's liability is limited to the amount of the order concerned, except in the case of fraud or gross negligence.
Article 11 — Personal data and intellectual property
Fluesco processes the customer's data for the performance of the order, invoicing, after-sales service and, with their consent, the sending of commercial information. Payment data are processed by Stripe; delivery data are passed on to the carrier. The customer has the rights of access, rectification, erasure, restriction, objection and portability provided by the GDPR, to be exercised by e-mail to info@fluesco.com. Full details are set out in the website's privacy policy.
The website, its structure, texts and visuals are protected by copyright. Manufacturers' trademarks, logos and data sheets remain the property of their owners. Any reproduction for purposes other than personal consultation is prohibited without written consent.
Article 12 — Recycling and environmental contributions
Fluesco is a member of the Belgian collective take-back schemes for waste electrical and electronic equipment (Recupel) and for batteries (Bebat). The corresponding contributions are included in the prices and itemised on the invoice.
When purchasing a new appliance, the customer may hand in an equivalent used appliance free of charge (“one-for-one” take-back), in store at collection or, for deliveries, as agreed with Fluesco. Small appliances and batteries can also be dropped off at Recupel and Bebat collection points. The customer erases their personal data before handing in an appliance.
Article 13 — Applicable law, disputes and mediation
These terms and every sale concluded by Fluesco are governed by Belgian law. If a clause is held to be void, the others remain applicable.
In the event of a complaint, the customer first contacts Fluesco (info@fluesco.com); Fluesco replies within 10 working days. The consumer may then refer the matter free of charge to the Belgian Consumer Mediation Service (North Gate II, Boulevard du Roi Albert II 8 box 1, 1000 Brussels, consumerombudsman.be) or use the European online dispute resolution platform (ec.europa.eu/consumers/odr). Fluesco undertakes to take part in good faith in any mediation.
Failing an amicable solution, the courts of the judicial district of Liège have exclusive jurisdiction over disputes with business customers. For consumers, the competent court is determined in accordance with the Belgian Judicial Code.
